By accessing and/or using the 365RMA portal you acknowledge that you have read, understood and agree, to be bound by these terms set out below and all other disclaimers, guidelines, policies and terms and conditions appearing on this Site and to comply with all applicable laws and regulations. If you do not agree to these terms, do not use this Site. The Terms of Use constitute the entire agreement between you and Schumacher with respect to this Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written between you and Schumacher. The Terms of Use are subject to change at any time without prior notice. By using this Site, you agree to be bound by any such revisions.

• By using the Site you are confirming that you are the legal owner of the unit which is alleged by you to be defective in some manner.
• You agree that there was no damage to your property or the property of others through the use of the allegedly defective unit.
• You agree that there was no personal injury to yourself or others through the use of the allegedly defective unit.
• You agree that the allegedly defective unit is not considered to be evidence in any pending or potential legal proceeding.
• You are confirming that there is no insurance company that has been contacted or that may have an interest in subrogating a claim against Schumacher as a result of the use of the allegedly defective unit.
• You agree to release any and all claims, law suits, or other actions for property damage, personal injury, or otherwise, on behalf of you, your respective heirs, assigns, employers, insurers, and/or any other person or entity who may have rights to a claim against Schumacher, and/or its respective heirs, assigns, employers, insurers, or any other entity for any damages from the use of the allegedly defective product.
• You agree to indemnify and hold harmless Schumacher, and/or its heirs, assigns, employers, insurers, or any other entity for any and all claims, law suits, and damages associated with the use of the allegedly defective unit.
• Upon your RMA request being granted and a new unit being sent to you, you agree to never again operate and to safely disable the unit that is alleged by you to be defective as per the below instructions.
• Customer agrees to dispose of the disabled unit in accordance with all applicable local, state, and federal regulations. If you are unsure of where to properly dispose of the disabled unit, please consult the following resources: 1)Contact Schumacher at the number listed in the manual and a Customer Service Representative will assist you; 2) Contact your local electronic recycling facility; 3)Visit the following site to learn of a recycling location near you www.call2recycle.org
• Schumacher does not make any representations or warranties about any Web site you may access through this site. A link between this Site and another Web site does not mean that Schumacher endorses that Web site.
• The Terms of Use are governed and interpreted pursuant to the laws of the State of Illinois, United States of America, notwithstanding any principles of conflicts of law.
